Payday Loan Collector Can't Shake TCPA Suit

By Juan Carlos Rodriguez (January 10, 2014, 4:04 PM EST) -- A Nevada federal judge on Tuesday rejected payday lender Cash 1 LLC's bid to shut down a proposed class action accusing it of illegally calling consumers' cellphones, finding there was still a question about whether it could have made the calls.

The plaintiffs in the suit sued a group of payday lenders including Cash 1, Check City Partnership LLC and Dollar Loan Center LLC for allegedly violating the Telephone Consumer Protection Act and the Deceptive Trade Practices Act. The complaint said the companies invaded the plaintiffs' privacy by using an automatic telephone dialing system to initiate telephone calls to the plaintiffs...
