Peregrine Denied Preliminary Injunction In Patent Row

Law360, Los Angeles (January 10, 2014, 5:20 PM EST) -- A California federal judge on Wednesday rejected Peregrine Semiconductor Corp.’s bid for a preliminary injunction against competitor RF Micro Devices Inc., which bought the patent assignment from its inventor after he left Peregrine.

U.S. District Judge Marilyn L. Huff ruled that Peregrine didn’t effectively argue it would suffer irreparable harm if inventor and former employee Robert Benton were permitted to assign his work to RF Micro, according to the decision.

“Peregrine only asserts economic harm and loss of goodwill. Conclusory statements of economic harm and loss of goodwill are insufficient to support a finding of irreparable injury,” Judge Huff wrote in...
