Dwyer Head Calls NJ Atty Advertising Rule Unconstitutional

Law360, Philadelphia (February 18, 2014, 7:57 PM EST) -- A New Jersey employment attorney urged the Third Circuit on Tuesday to toss out a state judiciary committee’s rule that he said unconstitutionally bars him from excerpting judicial opinions as a means of advertising on his firm’s website.

Andrew Dwyer, head of the Newark, N.J.-based Dwyer Law Firm LLC, told a three-judge panel that a new rule by the state’s Committee on Attorney Advertising violated his rights to free speech and equal protection by restricting his ability to post quotes from judicial opinions on his website...
