Winn-Dixie Urges 11th Circ. To Revive Lease Exclusivity Suit

Law360, Miami (January 16, 2014, 7:05 PM EST) -- An attorney for Winn-Dixie Stores Inc. on Thursday asked an Eleventh Circuit panel to revive its suit against rival retailers over alleged violations of grocery exclusivity clauses in its leases, arguing that the trial judge erred in discounting a state appellate decision in the grocer's favor.

Tom Warner of Carlton Fields Jorden Burt, who argued on behalf of Winn-Dixie, said the district court refused to follow Florida law when it booted the bulk of nearly 100 requests by the grocer for damages and injunctions.
