High Court Won't Eye Obviousness In Newegg Patent Case

Law360, New York (January 13, 2014, 4:03 PM EST) -- The U.S. Supreme Court declined Monday to review a decision invalidating as obvious three Soverain Software LLC e-commerce patents that online retailer Newegg Inc. was accused of infringing, turning aside Soverain's argument that the decision threatened the stability of the patent system.

The justices denied a cert petition by Soverain that claimed the Federal Circuit improperly resolved factual questions regarding obviousness that only a jury can decide when it invalidated Soverain's patents, wiping out a $2.5 million infringement verdict against Newegg.
