Objector To $53M IPhone Warranty Deal Can't Depose Atty

Law360, San Francisco (January 13, 2014, 9:11 PM EST) -- A California federal judge ruled Monday that an objector to Apple Inc.'s $53 million settlement in an iPhone and iPad warranty class action can't depose one of the plaintiffs' attorneys, saying concerns about the attorney's potential conflicts of interest were resolved by earlier filings.

U.S. Magistrate Judge Donna Ryu said that objectors such as attorney Steve Kessinger, who made the request, can only take discovery in “exceptional circumstances,” and that his concern over attorney Mark Chavez's ties to several proposed cy pres recipients were answered in earlier disclosures made...
