NuVasive Can't Dodge Orthopedic Patent Suit

Law360, Los Angeles (January 15, 2014, 7:44 PM EST) -- A California federal judge on Tuesday denied medical device company NuVasive Inc.’s attempt to toss rival AngleFix Tech LLC’s allegations that NuVasive infringed a patented screw-and-plate system used in orthopedic operations, ruling that claims construction was premature at this stage of the case.

U.S. District Judge Roger T. Benitez dismissed NuVasive’s motion for a judgment on the pleadings, which argued that NuVasive’s product missed a particular type of screw required in AngleFix’s patent. Because AngleFix and NuVasive did not agree on their interpretation of the claims,...
