9th Circ. Throws Out Medical Marijuana Dispensary Suits

Law360, Los Angeles (January 15, 2014, 10:55 PM EST) -- The Ninth Circuit on Wednesday affirmed the dismissal of three suits brought in California federal court over the right of medical marijuana dispensaries to conduct business without interference from the federal government.

The three-judge panel summarily rejected the arguments set forth by the collectives, which contended that the enforcement of federal laws against marijuana consumption went counter to the Ninth and Fifth amendments, according to Wednesday’s decision.
