5th Circ. Strikes Tax Preparer's $3.7M Restitution Order

Law360, New York (January 16, 2014, 3:37 PM EST) -- The Fifth Circuit on Wednesday struck down a $3.7 million restitution award a tax preparer was ordered to pay after pleading guilty to tax fraud, ruling the award far exceeded the $7,500 in losses associated with the specific crime she copped to.

The appeals court said Shondrell Campbell can only be held accountable for tax losses tied to the offense for which she was convicted. Although the Internal Revenue Service paid more than $3 million in refunds on fraudulent returns Campbell helped prepare, she pled guilty...
