CSX Sues Hedge Funds Over Planned Proxy Fight

Law360, New York (March 17, 2008, 12:00 AM EDT) -- CSX Corp. has launched a preemptive strike against two hedge funds, accusing them of violating securities laws by employing swap agreements and planning a proxy battle at the company's upcoming annual meeting.

The transportation company said the lawsuit was filed Monday in the U.S. District Court for the Southern District of New York against The Children's Investment Fund and 3G Capital Partners. The suit was not immediately available in court dockets.
