Judge Not Racially Biased Against Investor, 2nd Circ. Says

Law360, Los Angeles (January 21, 2014, 4:18 PM EST) -- The Second Circuit refused Tuesday to toss out biotech financier David A. Blech's four-year prison term for his alleged role in a stock-manipulation scheme, denying his argument that the New York federal judge who ordered the sentence was racially biased.

Affirming U.S. District Judge Colleen McMahon's sentencing order, the appeals judges said she made multiple ill-conceived remarks that bordered on the inappropriate but added that they weren't convinced that Blech's sentence was based on unconstitutional factors, including race.
