SC High Court Throws Out Carnival Cruise Pollution Case

Law360, Chicago (January 22, 2014, 7:49 PM EST) -- The South Carolina Supreme Court on Wednesday tossed a suit accusing cruise company Carnival Corp. of polluting the Port of Charleston’s waters and eroding the city’s historic character, finding that the citizen groups behind the complaint lacked standing to sue.

The plaintiffs, led by the South Carolina Coastal Conservation League, failed to show that it — or its members — suffered any “particularized harm” from the presence of Carnival’s 10-story, 1028-room Fantasy cruise ship in Charleston, according to an opinion penned by Justice Kaye G. Hearn....
