High Court Nixes Microsoft’s Appeal In Novell Case

Law360, New York (March 17, 2008, 12:00 AM EDT) -- The U.S. Supreme Court will not hear Microsoft Corp.’s appeal of a decision that Novell Inc. has standing to sue the software giant for allegedly squeezing out competitors in the PC operating systems market even though Novell is not a participant in that market.

The high court shot down Microsoft’s petition for a writ of certiorari on Monday, clearing the way for Novell to move forward with its antitrust case.
