High Court Denies Cert In Blood Storage Patent Suit

Law360 (March 17, 2008, 12:00 AM EDT) -- Spelling the end for PharmaStem Therapeutics Inc.'s case against Boston-based biotechnology company ViaCell Inc. over blood storage patents, the U.S. Supreme Court denied PharmaStem's writ of certiorari on Monday.

Peter Dehlinger of Perkins Coie LLP, the firm that represented PharmaStem in applying to bring the petition, said that though he was disappointed, the outcome was not surprising.

“We were certainly hopeful that the Supreme Court would take the case, but I think every appellant understands that its a long shot in the present environment,” Dehlinger said....
