4th Circ. OKs Incentives For Dominion Transmission Projects

Law360, New York (January 27, 2014, 5:52 PM EST) -- The Fourth Circuit on Friday said the Federal Energy Regulatory Commission properly granted incentives to a Dominion Resources Inc. unit for five transmission projects, rejecting the claims of North Carolina utility regulators that the commission abused its discretion under the Federal Power Act.

The North Carolina Utilities Commission had challenged the incentives FERC granted in 2008 to five Virginia Electric & Power Co. transmission projects. They were part of a suite of 11 projects worth a combined $877 million for which VEPCO — doing business as...
