Justices Want SG's Take On Railroad's Fuel Tax Challenge

Law360, New York (January 27, 2014, 2:03 PM EST) -- The U.S. Supreme Court on Monday asked the solicitor general to weigh in on whether Alabama's 4 percent diesel fuel tax is discriminatory against rail carriers, delaying the state's bid to finally settle a nationwide split among circuits on the issue.

The high court's request for solicitor general input comes after Alabama asked for certiorari following a July decision by the Eleventh Circuit, where the federal court said the fuel tax levied against CSX Transportation Inc. and other rail carriers was improper because it wasn't levied...
