Sentences Tossed For Being Too Soft On Fraud

Law360, New York (March 18, 2008, 12:00 AM EDT) -- A federal appeals court threw out a lower court's decision Monday to give two convicted hotel chain executives tougher sentences for their involvement in a $100 million bank fraud scheme.

The Second U.S. Circuit Court of Appeals reversed the sentences meted out to Sanford Freedman, the former general counsel of the Days Inn hotel group, and former Chief Financial Officer James Cutler. The case was remanded to the U.S. District Court for the Southern District of New York for resentencing.
