TTAB Sides With Shape Magazine, Kills 'Shapes' Salon Mark

Law360, New York (January 28, 2014, 1:10 PM EST) -- The Trademark Trial and Appeal Board issued a precedential ruling last week that a beauty salon named “Shapes” could not register its name as a trademark because of American Media Inc.’s beauty-centric “Shape Magazine.”

The board acknowledged that two parties wanted to use their near-identical marks for different things — Shapes for salon services, American Media for magazines and websites — but found that Shape Magazine’s editorial focus on beauty care meant consumers would nonetheless be confused by a salon under the same name.
