Law360, New York (January 28, 2014, 6:20 PM EST) -- The Federal Trade Commission argued Monday in Pennsylvania federal court that Cephalon Inc. had put the testimony of its former general counsel at issue in the antitrust watchdog's pay-for-delay suit, saying the company should either be compelled to turn over the materials or blocked from using them at trial.
The agency accused Cephalon of twisting the position the FTC took in a motion to compel in order to skirt the real question at issue in the dispute.
