Cook Wins Judgment In Heart Graft Patent Case

Law360, New York (March 18, 2008, 12:00 AM EDT) -- A federal court has ruled that endovascular grafts manufactured by Cook Inc. do not infringe patents held by Edwards Lifesciences LLC, putting to rest a long-standing patent dispute over the devices, which are used to treat aneurysms.

Judge Jeffrey S. White of the U.S. District Court for the Northern District of California granted Cook summary judgment of non-infringement on Tuesday, drawing on the court’s 2007 claim construction ruling to determine that Cook’s allegedly infringing devices did not contain the “malleable” wires described in Edwards’ patents....
