Cartelists May Face Liability For 'Umbrella' Pricing In EU

Law360, New York (January 30, 2014, 4:36 PM EST) -- Cartel members should be on the hook for damages caused by higher rates charged by other industry players who weren’t in the cartel but took advantage of it to charge supracompetitive prices, an adviser to the European Union’s highest court said Thursday.

Advocate General Juliane Kokott urged the European Court of Justice to conclude that under EU law, those injured by a cartel should be able to pursue their damages from the cartel’s participants — even if they bought products from another seller who didn’t participate...
