Fla. Spray-Foam Insulation Suit Survives Dismissal Bid

Law360, Miami (January 31, 2014, 8:22 PM EST) -- A Florida federal judge on Friday dismissed one claim in a putative class action over allegedly defective spray polyurethane foam insulation against manufacturer Lapolla Industries Inc. and local distributor Air Tight Insulation of Mid-Florida LLC, but allowed the bulk of the case to proceed.

U.S. District Judge Charlene Edwards Honeywell tossed Robert and Cynthia Gibson's medical-monitoring claim, ruling that they had not specified any single serious condition or group of serious conditions that they are at an increased risk of contracting because of the spray-foam insulation....
