Tribal Authority Must Face Toxic-Housing Claims

Law360, New York (March 19, 2008, 12:00 AM EDT) -- An appeals court has ruled that a tribal housing authority must face claims that government houses it bought or leased were treated with toxic chemicals, causing a group of Blackfeet Indians to suffer from health problems including cancer.

In a divided ruling Wednesday, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit reversed the dismissal of the plaintiffs' claims against the Blackfeet Housing Authority and its board members. The court also reversed dismissed claims under the Administrative Procedure Act.
