Class Cert. Granted In TCPA Junk Fax Suit Against MetLife

Law360, New York (February 5, 2014, 1:53 PM EST) -- A Florida federal judge on Tuesday granted class certification in a lawsuit accusing Metropolitan Life Insurance Co. of violating the Telephone Consumer Protection Act by sending junk fax advertisements to businesses and individuals without their consent.

C-Mart Inc. alleges MetLife hired another defendant, Scott Storick, an executive at Storick Group Co. and Storick Group Corp., to sell life insurance. Storick then allegedly sent unsolicited identical advertisements via fax to about 35,000 Missouri residents between Aug. 7, 2012, and Sept. 6, 2012, of which C-Mart received one....
