Defense Can Bring Back US's Madoff Witness, Judge Rules

Law360, New York (February 5, 2014, 7:46 PM EST) -- A New York federal judge on Wednesday refused to allow the U.S. government to exclude its one-time star witness in the Bernie Madoff case from further cross-examination in regard to his Fifth Amendment privilege in a related civil proceeding.

In December, a defense attorney in the fraud case against Madoff suggested that Frank DiPascali, the former star witness and top Madoff lieutenant, had lied, saying he falsely implicated his former colleagues to win a plea bargain.
