Disney Unit Playdom Kills Rival Mark At TTAB

Law360, New York (February 6, 2014, 5:17 PM EST) -- The Trademark Trial and Appeal Board sided with Walt Disney Co. Monday in its bid to register the name of its social gaming subsidiary Playdom Inc., canceling a rival “Playdom” mark on the grounds that the owner wasn't actually using it when he applied.

When registrant David Couture filed to register the name back in 2008 for “entertainment and educational services” consisting of advice on “concept and script development,” he did so with a Section 1(a), “actual use” application rather than a Section 1(b) “intent-to-use” application....
