FERC Mulls Refunds In 2000-2001 Energy Crisis

Law360, New York (March 21, 2008, 12:00 AM EDT) -- The U.S. Federal Energy Regulatory Commission has ordered a hearing to examine whether any electric companies charged customers unjust and unreasonable rates during the Western energy crisis in 2000 and 2001.

FERC said Thursday that the hearing before an administrative law judge will address a 2004 decision by the U.S. Court of Appeals for the Ninth Circuit that FERC had the authority to order power companies to pay refunds to customers. FERC had already found that the companies had violated market-based reporting requirements.
