Versata Wants Suit Over USPTO Biz Method Definition Revived

Law360, New York (February 7, 2014, 8:29 PM EST) -- Versata Software Inc. told the Federal Circuit on Thursday that a judge erroneously threw out its suit claiming the U.S. Patent and Trademark Office uses an "overly expansive" definition of a business method patent in a new America Invents Act program.

U.S. District Judge Gerald Bruce Lee dismissed the suit in July, ruling that the AIA precludes lawsuits challenging the USPTO's decisions on whether to institute business method reviews, but Versata said in its appellate brief that the law does no such thing.
