Tyco Shells Out $330M In Masimo Settlement

Law360 (January 24, 2006, 12:00 AM EST) -- A subsidiary of industrial conglomerate Tyco International Ltd. has ended its long-standing patent battle with boutique healthcare technology company Masimo Corporation over devices for measuring blood-oxygen levels with a $330 million settlement agreement.

Under the terms of the settlement, Nellcor, a division of Tyco Healthcare, has agreed to fork over $265 million in damages as well as an advance royalty payment of $65 million related to sales of Nellcor’s new line of pulse oximetry products for the coming fiscal year.
