NY Hospital Settlement Could Be Model For Future Mergers

Law360, New York (February 12, 2014, 2:30 PM EST) -- In December 2013, the New York Office of Attorney General entered into a settlement with St. Elizabeth Medical Center (SEMC) and Faxton-St. Luke’s Healthcare (FSL), the only two general acute care hospitals in Utica, N.Y., allowing them to affiliate under a single parent entity.[1]

The settlement is a reminder that the Federal Trade Commission and the U.S. Department of Justice are not the only entities that scrutinize hospital mergers, and that in some jurisdictions state enforcers are taking the lead in reviewing health care transactions.[2] But...
