Law360, Los Angeles (February 12, 2014, 4:17 PM EST) -- A California federal judge on Tuesday tossed a false claims and copyright suit launched against Foray Technologies Inc. — which makes software for authenticating crime-scene photos — by competitor Kwan Software Engineering Inc., ruling the plaintiff did not properly back up its misleading statements claim.
U.S. District Judge Susan Illston ultimately granted Foray’s motion for summary judgment, ending Kwan’s suit against it. Kwan had claimed Foray misled consumers by saying its software “authenticated” photos, citing industry guidelines for the term.
