Almond Co. Fights 'Diamond' Trademark Infringement Claim

Law360, Los Angeles (February 13, 2014, 7:08 PM EST) -- Blue Diamond Almond Growers Corp. asked a California federal judge on Wednesday to determine that it is not infringing on an Alabama company’s trademark with the branding on its almond milk-based iced coffee beverages.

Blue Diamond has held trademarks for its nut-based food and beverage products since at least 1999, the company said. But when it started selling iced coffee under the brand, Southern coffee purveyor Red Diamond took offense, alerting the California company’s attorneys that the labeling was confusing, Blue Diamond said in its suit....
