NY Issues Updated Hazardous Waste Monitoring Policy

Law360, New York (February 13, 2014, 6:21 PM EST) -- The New York State Department of Environmental Conservation on Wednesday proposed a new environmental monitoring rule for hazardous waste facilities, updating a 22-year-old policy used to determine whether properties need additional environmental oversight.

The proposal calls for environmental monitors when material being handled at the facility is “of particular concern due to its characteristics or quantity,” or when the facility has a history of repeated violations at the local, state or federal level.
