Orange County Retirees Can't Pool Benefits, 9th Circ. Says

Law360, Los Angeles (February 13, 2014, 6:13 PM EST) -- The Ninth Circuit on Thursday held that 4,600 retired employees of Orange County, Calif., do not have an implied contractual right to pool their health insurance premiums with those of current employees, affirming a district court’s ruling in favor of the county.

The suit arose from the county’s decision to stop pooling retired and active employee health insurance premiums in 2008, which meant that current employee health benefit premiums would be calculated separately from those of retired employees.
