Hospital's Suit Over NY Workers' Comp Law Dismissed

Law360, Los Angeles (February 13, 2014, 6:08 PM EST) -- New York’s highest court on Thursday rejected a hospital's attempt to revive an indemnification suit against a contractor who allegedly hired two undocumented immigrants who were injured doing demolition work, ruling their immigration status did not affect the contractor’s rights.

Judge Susan Phillips Read, writing for a unanimous court, dismissed New York Medical Center of Queens’s suit alleging that Microtech Contracting Corp. wasn't entitled to the indemnification protection of the state workers' compensation statute because the company ran afoul of federal immigration law.
