Class Urges 10th Circ. To Back $1B Dow Antitrust Award

Law360, New York (February 18, 2014, 7:16 PM EST) -- A class of urethane buyers urged the Tenth Circuit on Friday to uphold a $1.06 billion price-fixing judgment against Dow Chemical Co., saying extensive evidence supports the jury's verdict and that decertifying the class now would be unprecedented.

The buyers criticized Dow's arguments that there wasn't enough evidence to support the trebled $400 million jury verdict, telling the appeals court that a "vast evidentiary showing" underpinned the conclusion that Dow had conspired with other chemical companies to boost urethane prices.
