7th Circ. Affirms Reduced Atty Fee In TCPA Settlement

Law360, New York (February 18, 2014, 7:29 PM EST) -- The Seventh Circuit on Tuesday upheld a reduced attorneys' fee award in a junk fax class action settlement, rejecting the class counsel’s argument that the district court improperly calculated the amount.

The appeal centered around a $6.1 million settlement agreement reached between plaintiff Americana Art China Co. Inc., defendant Foxfire Printing & Packaging Inc. and Foxfire’s insurer, Continental Casualty Co., after Foxfire admitted to violating the Telephone Consumer Protection Act.
