Deployed Ex-Lowe's Worker Gets Retrial In Benefits Scrap

Law360, New York (February 19, 2014, 6:58 PM EST) -- A New Jersey appellate panel ordered a new hearing for a former Lowe’s Home Centers Inc. employee to determine his standing to collect unemployment benefits, ruling Wednesday that he was improperly excluded from the proceedings due to his military deployment.

In a published decision, a three-judge panel on the Superior Court of New Jersey’s Appellate Division ruled in favor of William E. Newman Jr., overturning the New Jersey Department of Labor Board of Review's decision, which had upheld reversing the approval of Newman’s unemployment benefits. The...
