3rd Circ. Restores Bulk Of Pa. Funeral Director Law

Law360, New York (February 19, 2014, 7:06 PM EST) -- The Third Circuit on Wednesday overturned nearly all of a ruling that found parts of Pennsylvania’s 60-year-old Funeral Director Law anti-competitive and unconstitutional, reinstating provisions that allow warrantless inspections of funeral homes and encourage consumer-friendly ownership structures.

A unanimous panel reversed the bulk of a federal court’s decision backing a consortium of players in the funeral management industry and enjoining the Pennsylvania Board of Funeral Directors from enforcing several aspects of its sprawling statutory regime.
