Insurer Appeals Dealership's Sandy Business Interruption Win

Law360, New York (February 20, 2014, 6:03 PM EST) -- Tower National Insurance Co. said Wednesday it is appealing an order allowing a Queens, N.Y.-area Nissan dealership to seek up to $3 million in Superstorm Sandy-related business interruption coverage, arguing the policy does not cover occurrences stemming from flood damage.

The insurer gave notice that it will appeal New York Supreme Court Judge Jeffrey Oing's Jan. 16 bench ruling finding that the policy's flood exclusion was inapplicable to Five Towns Nissan LLC's losses, which allowed Five Towns to seek coverage for the loss of business income...
