Everest, National Union Sued Over Defamation Row Coverage

Law360, New York (February 21, 2014, 4:08 PM EST) -- Everest National Insurance Co. and National Union Fire Insurance Co. were hit with a declaratory suit by a construction company seeking indemnification for an underlying $12.3 million defamation and unfair competition lawsuit in Utah federal court on Thursday.

The Layton Companies Inc. and Layton Construction Co. argue that the insurers must provide indemnification for a suit filed by a rival construction firm SIRQ Inc., which alleged defamation, slander, libel and more. The suit ended with a $13.2 million jury verdict in favor of SIRQ  in March...
