Fla. Appeals Court Revives Excavation Permit Suit

Law360, Miami (February 21, 2014, 7:07 PM EST) -- A Florida appeals court on Friday revived an excavation company's suit challenging the denial of a permit by DeSoto County, ruling that it could not determine whether a required presuit claim was timely filed.

Florida's Second District Court of Appeal reversed a lower court's order dismissing P.I.E.'s suit against DeSoto County because the company failed to file a presuit claim within one year of the county's action as required by state law.
