4th Circ. Axes Whistleblower's FCA Suit Against Omnicare

Law360, Los Angeles (February 21, 2014, 7:06 PM EST) -- The Fourth Circuit on Friday tossed a former worker's whistleblower False Claims Act suit alleging Omnicare Inc. violated federal regulations by selling contaminated drugs to the government, saying the employee didn't prove Omnicare made a false statement or knew it was engaging in wrongdoing.

In a published opinion, a three-judge panel affirmed a Maryland federal judge's dismissal of former Omnicare employee Barry Rostholder's qui tam suit because he didn't provide enough information to determine if any fraudulent action had occurred.
