High Court Rejects Atty's Appeal In $4M Junk Fax Case

Law360, New York (February 24, 2014, 2:26 PM EST) -- The U.S. Supreme Court said Monday it won’t hear an estate planning attorney’s appeal of a Seventh Circuit ruling regarding how a $4.2 million class action judgment for sending unsolicited fax advertisements should be distributed.

Attorney Gregory Turza said in his December petition for writ of certiorari that the Seventh Circuit erred in forcing him to pay the full amount of the judgment before any class members other than the plaintiff had submitted claims and despite its finding that the case didn’t involve a common fund....
