Plastics Co. Dodges Safety Fines Over Fatal Heater Explosion

Law360, Los Angeles (February 24, 2014, 10:32 PM EST) -- A California appeals court said Monday that a district attorney couldn't assess civil fines over plastics company Solus Industrial Innovations LLC's fatal workplace explosion, finding federal laws preempted the causes of action filed against the company.

Contrary to a lower court's ruling, the three-judge panel held that the state's U.S. Department of Labor-approved workplace safety plan doesn't include any provision for civil enforcement of workplace safety standards by a prosecutor for penalties under California's Unfair Competition Law.
