NY Justices Reopen Door For Lawsuit Against Broker

Law360, New York (February 25, 2014, 3:08 PM EST) -- New York's highest court on Tuesday revived a lawsuit blaming an insurance broker for inadequate business interruption coverage, with a majority of judges concluding that it was possible that the broker could be liable because of a “special relationship” with the client bringing suit.

According to the majority, a lower court erred when it tossed a business owner's lawsuit against CH Insurance Brokerage Services over the level of business interruption coverage provided in a policy with The Netherlands Insurance Co. for losses from three roof breaches...
