10th Circ. Won't Rethink Abercrombie Win In EEOC Hijab Row

Law360, New York (February 26, 2014, 4:23 PM EST) -- The Tenth Circuit on Wednesday refused the U.S. Equal Employment Opportunity Commission's request for a full court review of a panel ruling that Abercrombie & Fitch Stores Inc.'s refusal to hire a Muslim woman because of her headscarf didn't amount to religious discrimination.

In denying the EEOC's rehearing bid, the appeals court said that its judges were evenly divided over whether to grant rehearing and that the agency's petition must therefore be rejected.

The agency was hoping to get the court to review en banc a 2-1 panel decision issued Oct. 1 that overturned an Oklahoma federal court's judgment for the EEOC that Abercrombie was liable...
