Fired Associate Rightly Given Unemployment, NY Court Says

Law360, New York (February 28, 2014, 2:48 PM EST) -- An associate fired in 2011 by Bruno Gerbino & Soriano LLP for accepting a no-fault insurance settlement offer without conferring with a partner or the client was properly awarded unemployment benefits because his actions didn't amount to misconduct, a New York appellate court said Thursday.

Brandon D. Okano's initial application for unemployment insurance was denied but, in September 2012, an administrative law judge with New York's Unemployment Insurance Appeal Board overruled that decision and awarded the benefit.
