Luminant Beats $470M Pollution Suit Over Texas Coal Plant

Law360, New York (February 28, 2014, 7:05 PM EST) -- A Texas federal judge said Wednesday that operations at a coal-fired plant owned by Energy Future Holdings Corp. subsidiary Luminant Generation Co. LLC did not violate the Clean Air Act, ending the Sierra Club’s $470 million suit against the energy giant.

At the conclusion of a three-day bench trial, U.S. District Judge Walter S. Smith rejected Sierra Club’s complaint that Luminant’s Big Brown Steam Electric Station in Freestone County released illegal levels of particulate matter pollution on more than 6,000 occasions beginning in July 2007. The...
