Tort Win Falls Outside Workers' Comp Cap, Fla. Justices Hear

Law360, Miami (April 10, 2014, 5:44 PM EDT) -- The family of a landscaping employee killed on the job asked the Florida Supreme Court on Thursday to let them collect a $9.5 million judgment from his employer's insurer, calling it a tort judgment that fell outside of a workers' compensation cap in the policy.

Tracy Gunn of Gunn Appellate Practice PA told the justices that her clients, the family of a worker named Santana Morales Jr. who was killed in a landscaping accident in 1997, should be able to collect the judgment from Zenith Insurance...
